Bad Faith (Domain)
The intent to unfairly exploit a trademark when registering a domain — a required element in UDRP complaints.
In domain law, bad faith refers to the intent to unfairly profit from a trademark or brand when registering or using a domain name. The UDRP outlines specific bad-faith indicators: registering to sell to the trademark owner at a profit, registering to block a competitor, registering to disrupt a competitor's business, or intentionally attracting users for commercial gain by creating confusion with a trademark. Generic or descriptive domain registration is not bad faith.
